LWEC in New York State

Since the inception of the 2007 Workers’ Compensation Reform and 2012 Disability Impairment Guidelines in New York State, loss of wage earning capacity (LWEC) is an important factor in determining the duration of benefits at the time of classification. After the medical disability and functional loss have been decided, a vocational assessment will provide critical data to assist judges with decisions about the injured worker’s earning potential after permanency is established.
